Replacing Tailored Fixed Fees

We have replaced Tailored Fixed Fees (TFF) with standard fees from 1st October 2007 for those categories of law not covered by a category-specific fee scheme. The schemes apply to all cases started on or after 1st October 2007.

For almost 70% of solicitors’ firms, the new fees represent an increase in the current average cost of the cases to which they will apply.

When comparing the fees with the TFF rate, please consider that TFF rates include:

VAT - the fixed fees published in Legal Aid Reform: The Way Ahead were shown net of VAT, which we will pay on top
disbursements – under the new scheme all disbursements except counsel’s fees are payable in addition to the fixed fees
exceptional cases - you don’t normally receive extra payments for these. However, in the new scheme, all exceptional cases (those where the costs on hourly rates are three times the fee) will be paid separately at hourly rates.

Where do the new fees apply?

The new fees will apply in the following categories of law:

actions against the police
clinical negligence
community care
consumer
debt
education
employment
housing
personal injury
public law
welfare benefits.

They are effective from 1 October 2007.
