Guidance produced for Advocates’ Graduated Fee Scheme

New guidance aims to help claimants

All Advocates' Graduated Fee Scheme (AGFS) claims are checked for accuracy against information held by the court, which is collected and updated as the case progresses.

A significant number of claims fail this check, which can mean that payment is delayed whilst the claim is returned to the claimant or while further checks are made by court staff.

Claims can fail the check against the court record if they contain incomplete or inaccurate information.

The LSC has produced a guidance document on the AGFS scheme that provides helpful tips on avoiding common problems and a checklist to ensure that all claims contain the correct information.

In addition, the document includes detailed guidance on how to comply with the obligation imposed by the Funding Order to inform the court of the identity of the Instructed Advocate and also on the process for claiming Pages of Prosecution Evidence (PPE).
