Advice on submitting LF1 claims
16 March 2010Some things to bear in mind when submitting claims under the Litigator Fee scheme
When submitting an LF1 claim form the following supporting information should be submitted in order to assist the Litigator Fee Team in validating your claim :
- The Representation Order (where there has been a transfer of solicitors and you are the new solicitors, please supply a copy of the representation order issued to the original solicitors)
- The paginated front sheet(s) from the Committal Bundle and NAEs served by the Prosecuting Authority (required for all final graduated fee claims).
- A copy of the Indictment (required for all final graduated fee claims).
- Original disbursement vouchers (for claims exceeding £20 excluding VAT and mileage)
- Prior authority confirmation (where necessary)
Claiming for Electronic Evidence
Where the litigator receives prosecution evidence on CD-Rom, and a paper copy of that evidence has been served on the court, the pages that have been served on the court will be counted as PPE for the purpose of the graduated fee.
Where the litigator and the court are both served with prosecution evidence on CD-Rom, litigators can claim for special preparation 26, provided the prosecution evidence on that CD-Rom falls within the definition of PPE in the Funding Order.
Remuneration for listening to or viewing audio or video footage such as interview tapes or CCTV is wrapped up in the fee and cannot be claimed as special preparation.
