These forms are not mandatory until 5 Jan 09. Version 4 forms that have been signed and dated up to and including 31 Dec 08 will be accepted by Courts until and including 31 Jan 09.

There are a small number of applicants where the use of Version 5 of the CDS14 is mandatory from 27 Oct, namely:

(i) If s/he is in receipt of Income Based Employment & Support Allowance (ESA) which becomes available for new claimants on 27 Oct 08;

(ii) The case will be heard in the Crown Court.
