Contracts for panel members and advocates
See Documents for contract documents for panel members and advocates. We have since made three amendments, which are:Amendment 1: Rates of pay
The latest rates for litigators and advocates took effect on 13 Nov 08 and apply to all work undertaken on or after this. These are interim provisions to ensure that very high cost cases are dealt with effectively and economically until the current scheme expires.
Copies of these rates and the contract amendment notices can be found in the documents panel on the right of this page.
Amendment 2: Non-panel advocates
We're aware of comments from practitioners and their representative bodies. In particular, the Bar Council raised issues about the operation of the 21-day procedure in Annex 9 to the panel member's contract.
A suggestion was to streamline the procedure to simply require the panel member to confirm they have used all the reasonable endevours to instruct a panel advocate with the required skill and experience before proceeding to instruct off-panel, if necessary. This is provided they notify the LSC's Complex Crime Unit.
Copies of these contract amendment notices can be found under documents.
Amendment 3: Extension
Following the outcome of the VHCC consultation the LSC, together with the Working Group, have decided to offer extensions to the current Panel Contracts for Very High Cost Cases.
Copies of these contract amendment notices can be found under documents.
