Appeals
Applicants can appeal against the decision to fail an application on the Interests of Justice test decision in two ways:
- applicants or solicitors can annotate the original application for legal aid
- applicants can write a letter to the court requesting an appeal.
The Magistrate will decide whether or not the application will be granted on appeal.
Appeals against applications that fail the Interests of Justice test will be dealt with within 24 hours of the appeal submission.
