Advice at the police station
Any person detained at the police station is entitled to free and independent legal advice and assistance.
In certain circumstances that advice can only be provided by telephone.
When legal advice is requested two options are available:
- the duty solicitor
- the client’s own solicitor.
The LSC pays for advice given to a client by a duty solicitor. We will pay for advice from a client’s own solicitor only if they hold a 2010 Standard Crime Contract.
R v Hookway
Providers will be aware of the High Court decision in the case of R v Hookway. We have published some billing guidance in light of the judgment. See the documents panel on the right hand side.
Domestic Violence Prevention Orders
The Home Office is undertaking a 12-month pilot to trial a new approach to tackling domestic violence. A key strand of this will be the use of Domestic Violence Protection Orders.
There are three police forces participating in the trial:
- Greater Manchester
- Wiltshire
- West Mercia

CDS Direct is our scheme to provide telephone advice to clients detained at a police station.
